Okay, Kim Kardashian's pregenancy is the first big pop culture news of 2013 and the baby will no doubt be the center of paparrazzi attention later this year. While the reality TV star is currently with rap superstar Kanye West, no one is forgetting the fact that the 32-year-old is still legally married to Brooklyn Nets forward Kris Humphries.

And, TMZ has found out, that according to California law, when a couple is still legally married, the husband must be the "presumed father", which means, as of right now, West cannot claim to be the father until a test proves so -- Humphries is the one everyone should assume is the father.

Meanwhile, Perez Hilton reports that Humphries has refused to acknowledge the baby at all, even though he's -- again -- technically married to Kim still and is, by California law, the presumed father. 

Here's what Hilton reports:

"Kris won't talk about Kim's pregnancy. [Kris' girlfriend] Myla [Sinanaj] hasn't asked about it and he hasn't mentioned anything about it. They talk about everything, but they don't talk about Kim - Kris never wants to. It's negative s**t, so they keep positive and only talk about everyday life, not Kim. Kris has to hear about it on Twitter, everytime he's out, at basketball games - people yelling in the crowd. He can't go to an event without Kim being mentioned, so it's always in his face. When it's just Kris and Myla, that's like real life - away from the bulls**t, where he can just be him." 

We'll say this: if this drama drags out longer, Kanye West's next song will be instantly one of the most quotable songs of 2013. It could make a run at Ether and Takeover as the greatest diss track of them all.
